Helen Steel y Dave Morris, los dos afectados, eran parados y no poseían bienes de modo que no pueden abonar ninguna sentencia que el tribunal pueda dictar en caso de encontrarles culpables. La mayoría de las personas amenazadas mediante acción judicial han tenido que disculparse por ser incapaces de permitirse el riesgo de tener que pagar grandes sumas en gastos judiciales y compensaciones si el caso fuese ganado por McDonalds.
